Welcome to FINDALL.COM.MY website (the “Site”).
These terms and conditions (“Terms & Conditions”) apply to all registered members of the Site and take effect upon registration of the member account. The term “Member(s)” refers to both Sellers and Buyers. By completing the member registration process, you indicate your understanding and acceptance of these Terms & Conditions. If you do not agree to these Terms & Conditions, please refrain from signing up as a registered member of Findall.com.my. Findall reserves the right to amend these Terms & Conditions at any time. The latest version will be published on the Site and will be effective immediately upon posting. All registered members should periodically review these Terms & Conditions to stay informed of any changes. Your continued use of the Site constitutes acceptance of the latest Terms & Conditions.
At Findall.com.my, membership comes at no cost to our registered users. Enjoy the benefits of membership without any fees or charges.
To become a Seller on Findall.com.my, each Member must complete the Seller registration process. We’re pleased to inform you that there’s no membership fee for Sellers. However, please note that for every transaction conducted, a 5% transaction fee will apply.
Each member hereby agrees and undertakes to:
1. Provide Accurate Information: Furnish true, complete, and accurate information regarding their business upon registration as a member.
2. Maintain Up-to-Date Information: Regularly update their business information to ensure it accurately reflects the current state of their business.
3. Publish Legal and Accurate Products: Display only products and product information that are legal, true, and accurate. Continuously update product information to ensure accuracy and relevance.
4. Conduct Business Ethically: Act with good faith, integrity, and honesty in all interactions and transactions on the Site.
5. Sell Legitimate Products: Offer for sale only products for which they have the legal right and authority to sell or distribute.
6. Manage Product Listings: Delete products or services that do not have any unfulfilled orders to maintain the integrity of listings.
Members shall not display or publish products or information that:
– Are illegal, including stolen, counterfeit, or destructive items, or items that violate applicable laws.
– Participate in schemes to defraud others.
– Infringe on third-party copyrights, patents, intellectual property, trademarks, or other legitimate rights.
– Create liability for Findall.com.my.
– Are misleading, defamatory, or offensive in nature.
Each member agrees to be fully responsible for all products and information published on the Site. Findall.com.my shall not be held accountable for any violations of law or terms by a member’s published product or information. Findall.com.my reserves the right to suspend or terminate a member’s account without notice for such violations. In cases of unlawful acts, Findall.com.my may disclose evidence or information to the relevant authority.
Each member also agrees to indemnify Findall.com.my for any losses suffered due to the member’s misconduct as described in these Terms & Conditions.
Each Member acknowledges and agrees to the following:
1. Endorsement Disclaimer: Findall.com.my does not endorse any member, product, information, comment, or message posted on the Site. Findall.com.my does not represent sellers or buyers in any transactions, either on the Site or offline.
2. Warranty Responsibility: Warranties relating to product conditions, quality, performance, reliability, and durability are solely the responsibility of the member. Findall.com.my is not liable for any breaches of warranty by a member.
3. Fraud Risk Acknowledgment: Despite efforts to screen users, there may still be a risk of dealing with fraudulent users on the Site. Members should exercise their own judgment in evaluating potential transaction partners.
4. Transaction Terms: Members are responsible for setting specific terms and conditions for each transaction, including warranty, shipping/delivery terms and charges, payment terms, etc.
5. Assumption of Risks: Members assume all risks associated with transactions conducted through the Site, including fraudulent transactions, delays, defaults, substandard products, breaches of contract, and transportation accidents.
6. Quality and Liability: Findall.com.my is not liable for the quality, safety, warranty, or availability of products or services offered for sale on the Site. Findall.com.my reserves the right to remove or delete postings that are suspected to be fraudulent, misleading, or offensive.
7. Transaction Records: Findall.com.my may request members to provide information and documents related to transactions for review and record-keeping purposes. Failure to provide requested information may result in account suspension or termination.
8. Secure Trade Service: For online transactions, Findall.com.my collects payments on behalf of sellers and holds them until buyers confirm receipt of goods. A transaction fee of 5% (subject to a minimum of RM1 per transaction) is charged to sellers for this service.
9. Dispute Resolution: Findall.com.my mediates disputes arising from online transactions between members. Each member agrees to indemnify Findall.com.my or the affected party for damages, liabilities, or costs arising from such disputes.
10. Proof of Delivery: In cases of non-receipt disputes, Findall.com.my may request sellers to provide proof of delivery. If delivery confirmation matches the order, no refund will be issued to the buyer.
11. Offline Transactions: Findall.com.my is not liable for any offline transactions between members. Offline transactions refer to those conducted directly between buyer and seller without using the online payment service provided on the Site.
These terms and conditions constitute the entire agreement between all members and Findall.com.my and shall be governed by and construed in accordance with the laws of Malaysia. All members and Findall.com.my hereby submit to the jurisdiction of Malaysia courts.
